THE QUESTION

“I got a speeding ticket in Charlotte.  The officer said I need to appear in court.  Is that correct?”

THE ANSWER

Your court appearance may be mandatory depending on the specific violation.  Speeds above 15 mph require that an individual appear in court.  Your appearance can not be waived by simply mailing in a fine. However, the individual can waive their court appearance by hiring a Charlotte traffic ticket attorney.   After retaining the law firm, our clients will receive a waiver form which allows our lawyers to appear on their behalf.

THE QUESTION

“I just got a Charlotte stop sign ticket but there are some mistakes on the ticket. Can I get the ticket thrown out?”

The typical answer is no.  North Carolina has adopted notice pleading requirements.  As such the ticket only needs to provide the bare bone facts to be valid. Mistakes about date of birth, the name of the road, or your driver’s license number are usually not fatal mistakes. However, there can be some instances where your NC traffic ticket is not valid and it is in your best interest to discuss this with one of our traffic attorneys.
